Apple Wins Vs. Samsung: Phone Ban Trial Date Set


Apple is not wasting any time in trying to extract justice from their competitor, Samsung. The South Korean company recently lost in court vs. Apple and were ordered to pay $1.05 billion in damages. The Cupertino company is now scheduled to battle it out in court again with Samsung on December 6 to fight for the banning of their competitors products in the U.S. market.



Apple is targeting at least 8 Samsung mobile devices to be banned on the U.S. market namely:


·         Galaxy S 4G

·         Galaxy S2 (AT&T)

·         Galaxy S2 (Skyrocket)

·         Galaxy S2 (T-Mobile)

·         Galaxy S2 Epic 4G

·         Galaxy S Showcase

·         Droid Charge

·         Galaxy S Prevail


The Galaxy S2 ban is even specific with carrier. Initially, the company was going after 28 Samsung devices. The eight mentioned are the ones currently being sold in the U.S. All of these devices are said to violate a utility, design, trade patents or was found infringing multiple patents over past several years. The Samsung Galaxy S3 is not included in the case.


Samsung’s Move Against the Ban


Although Samsung has already vowed to fight the ban on their products, the company has already expressed willingness to alter some of their products’ infringing features to keep their products from being banned.


According to an article on the Wall Street Journal, Samsung had a spokesperson release a statement saying: “We will take all necessary measures to ensure the availability of our products in the U.S. market.”


Although the final trial is set on December 6, there are still pre and post trials to take place. Samsung will continue to fight the battle till December.
